Cosby accuser to resume testimony in sex assault trial


Constand is one of around 60 women who have accused Cosby of sexually violating them but the prosecution has gone ahead on just Constand's allegations due to the statute of limitations passing for almost every other of those claims.

Johnson, a former assistant at the William Morris talent agency, testified Monday that in 1996 Cosby pressured her to take a pill that left her largely incapacitated. The married actor has always maintained the sex they had was consensual. "He said 'put them down [your throat]".

But Constand says she never got the records from Temple University for the work-issued phone.

Constand said the two continued their conversation, and alleged that although she told Cosby she didn't want to drink wine, he persuaded her. She has previously testified that she did not immediately share her allegations with police or her family. The Associated Press does not typically identify people who say they are sexual assault victims unless they grant permission, which Constand has done.

What's more, Constand's seemingly suggestive behavior toward Cosby was brought into question.

On the second day of the trial, Constandtook the stand to give her side of the story, alleging that the comedian gave her pills that paralyzed her and left her helpless as he sexually assaulted her. She said she felt his hand in her vagina and he placed her hand on his penis.

"She changed considerably", Patricia Sewell said in court.

Constand continued: "Mr. Cosby ... laid me down".

But when she reported the alleged attack to Canadian police on January 13, 2005, she said it happened in March 2004, after she'd gone out to dinner with Cosby and others at Central High School in Philadelphia, Cosby's defense lawyers said. Cosby is accused of drugging and sexually assaulting C. Johnson struggled to explain them.

Constand kept her cool during the onslaught, seeming to shrug off the inconsistencies as the types of "distractions" prosecutor Kristen Feden spoke about during her opening statement.

"I had a secret about the biggest celebrity in the world at that time, and it was just me", Johnson said.

The case is expected to last for two weeks.

Tuesday marked her first public appearance since she submitted to a deposition against Cosby in late December 2005, after waiting a year to report the alleged assault.

Gianna Constand said she received several phone calls from Cosby, including one in which he shared lewd details of his encounter with Andrea Constand and apologized.

He told jurors their relationship was romantic.

It was the first time Constand, 44, has testified publicly.

Ms Constand, a Canadian basketball trainer who was 31 at the time of the alleged assault, said she had spurned the actor's romantic advances on two previous occasions but had not felt threatened.

He asked what he could do to help, and she said all she wanted was an apology. "I thought I was having a bad reaction and I was panicking a little bit, but I knew I couldn't really get up and go anywhere at the same time because my legs were rubbery". Cosby potentially faces up to 10 years in prison on each of three related aggravated indecent assault charges, although the sentences could be merged, and he could get far less time if convicted.
